Purchase and Sales Rules


1. General provisions

1.1. These Rules of Purchase and Sales (further - the Rules) are a binding legal document that establishes the rights, duties and responsibilities of the Buyer (person purchasing services on the website) and the Seller (APL RESTAURANTS AKR UAB) (further - the Parties) when purchasing bowling services in O'Learys Sports Bar & Restaurant (address: Ozo str. 25, LT-08217, Vilnius) on the website e-olearys.com. The Buyer must read the Rules before purchasing services on this website.

1.2. The Seller stays the right to change, edit or supplement the Rules any time without prior notice. To the Buyer when using the services, will apply the Rules in force at the time of purchase of the services. The latest Rules are published on the website e-olearys.com.

1.3. If the Buyer clicks "I agree" before purchasing the services on the website e-olearys.com it is considered that the Buyer has read the Rules and undertakes to comply them.

1.4. In O’Learys Sports Bar & Restaurant website e-olearys.com have the right to purchase bowling services:

1.4.1. Capable natural persons: persons who have reached the age of majority and whose legal capacity is not restricted by court order;

1.4.2. minors between the ages of 14 and 18, only with the consent of their parents or guardians, unless they independently dispose of their income;

1.4.3. legal entities;

1.4.4. authorized representatives of all the above persons.

 

2. Conditions for purchasing services, procedure and rights of the Parties

2.1. With the agreement of Purchase and Sales the Seller undertakes to provide the Buyer services in O'Learys Sports Bar & Restaurant (address: Ozo str. 25, LT-08217, Vilnius) for a fee, and the Buyer undertakes to properly fulfill its duties and the conditions of the Rules.

2.2. The agreement of Purchase and Sales is considered concluded from the moment when the Buyer, having formed a service order, pays for the services on the website e-olearys.com, using prepayment or pay in cash or by card in O'Learys Sports Bar & Restaurant.

2.3. The Buyer is responsible for his actions for purchase which have done using the website e-olearys.com

2.4. The Buyer can get acquainted with the prices of bowling services on the website e-olearys.com. For inquiries, the Buyer have the right to appeal to O‘Learys Sports bar & Restaurant administration. Contacts of administration: +370 659 92012, apollo@apollo.lt

2.5. The Seller undertakes to create conditions for the Buyer to use the services provided by the website e-olearys.com

2.6. When ordering or purchasing bowling services on the website e-olearys.com, the Buyer must specify the correct personal data to the Seller: name, e-mail and phone number. The Seller is not responsible for the incorrect submission of the Buyer's data and the consequences thereof.

2.7. The Seller undertakes not to reveal the personal data provided by the Buyer to Third Parties. Information about the Buyer is used for the proper and high-quality provision of the service and to inform the Buyer about changes in the services.

2.8. The Seller is not responsible for damage caused by incorrect data or actions performed by the Buyer. If the Buyer has ordered and paid for a service that is not suitable for him or if he has not used the purchased services (not the fault of the Seller), the Seller is not obliged to compensate to the Buyer for the damage by him.

2.9. The Seller undertakes to publish free schedules and prices of the bowling game on the website e-olearys.com. The Buyer understands that bowling tracks can be reserved / purchased by several Buyers at the same time, so the system may not allow the desired time to be reserved until the program is currently updated.

2.10. If the Buyer is unable to use the purchased bowling services due to the Seller's fault at the time when it belongs to him according to the available ticket, the Buyer undertakes to contact the administration directly or by phone: +370 659 92012 immediately, but not later than the end of the Buyer's reserved time. If the interference caused by the fault of the Seller is not eliminated and the Buyer is not able to use the bowling services at the time belonging to him according to the available ticket, then the Seller undertakes to shift the Buyer's reservation time to another agreed time without additional payment. If the Buyer does not contact the administration within the specified time, or the interference are not confirmed, the reservation is not shifted and the money paid to the Buyer is not refunded.

2.11. The purchased ticket is valid only on the specified day and time at the specified address. Copy an e-ticket is strictly prohibited. Tickets are non-exchangeable and non-refundable.

2.12. The Seller is released from any liability if the Buyer has not read these Rules.

 

3. Marketing and Information

3.1. The Seller can publish various promotions on the website e-olearys.com.

3.2. The seller has the right to change the terms of the special offers and cancel them without notice. Any change in the terms of the special offers is valid from the moment of their complete (change).

3.3. The Seller sends all notifications to the contacts specified by the Buyer.

3.4. The Buyer sends all notices and questions to the contacts specified by the Seller on the website e-olearys.com.

3.5. If the Buyer does not receive the sent information or confirmation messages due to internet connection, e-mail service provider network disruptions, the Seller is not responsible for it.

 

4. Final Provisions

4.1. These Rules of Purchase and Sales have been prepared in accordance with the laws and legal acts of the Republic of Lithuania.

4.2. All disagreements arising from the implementation of these Rules is resolved through negotiations. If no agreement is reached, disputes is settled in accordance with the laws of the Republic of Lithuania.

 

5. Out-of-court agreement

5.1. The Client can submit his claims / requirements regarding the services provided by APL Restaurants UAB directly to APL Restaurants:

5.2. If the customer is not satisfied with the final response of APL Restaurants UAB regarding the out-of-court agreement of consumer disputes, he may apply to the State Consumer Rights Protection Authority:
